On Wednesday, Bayer’s stock rose 17% before trading had to be halted. That is the opening sentence. Everything else is context.

In a 7-2 ruling this morning, the court’s majority held that Americans cannot sue Bayer in state courts for failing to warn them that Roundup might cause cancer. The case centered on John Durnell, a Missouri man who developed non-Hodgkin lymphoma and won a $1.25 million jury verdict. That verdict is gone now. And so, potentially, are tens of thousands of others like it.
The ruling didn’t say Roundup is safe.
It said the EPA’s label, the one that carries no cancer warning, creates a federal ceiling that state courts cannot pierce. A liability shield.
That distinction matters enormously, because the science the EPA is relying on is itself deeply contested.
The World Health Organization’s International Agency for Research on Cancer classified glyphosate as “probably carcinogenic” in 2015. Two large meta-analyses have linked it to elevated rates of non-Hodgkin lymphoma. EPA scientists’ own internal risk assessments were overridden by agency leadership under industry pressure, a fact documented in internal emails obtained through litigation. The EPA’s conclusion that glyphosate is “not likely carcinogenic” is not a scientific consensus. It is a regulatory position, taken under documented influence, that seven justices just made the law of the land.
This didn’t happen in isolation. In February, President Trump signed an executive order invoking the Defense Production Act to boost domestic glyphosate production , triggering a liability shield for manufacturers under that same statute. The Department of Justice then filed an amicus brief at the Supreme Court defending Bayer’s immunity.
The executive branch built the runway. The Supreme Court just landed the plane.
What the financial press grasps that MAHA hasn’t fully reckoned with: this ruling is not about Roundup. It is a template, and by tonight it will be in the hands of every corporate defense attorney in America.
The logic, that a federal agency’s approval creates a ceiling above which state courts cannot impose liability, applies wherever a federal agency has set a label, a standard, or a registration. Generic drug makers, already protected from failure-to-warn suits since 2011, will cite Monsanto v. Durnell in every filing. Medical device manufacturers whose products cleared FDA premarket approval have operated under a similar shield since 2008; today’s ruling tightens it. PFAS manufacturers are watching closely: the moment EPA sets enforceable forever-chemical standards, those standards become a liability shield under precisely today’s reasoning.
The tobacco industry built this road in Cipollone v. Liggett in 1992. Bayer just paved it in asphalt.
The MAHA movement didn’t just fail to stop this. It helped build the political conditions that made it possible.
The people who rallied around Trump, Kennedy, and Zeldin in 2024 were told they were voting for a health revolution. Instead, they handed the presidency to a man whose Justice Department filed a brief defending Bayer’s immunity, and whose EPA is now the single institution standing between Monsanto’s label and any accountability in court.
You cannot campaign for the people who built this architecture and then express shock when the building goes up.
And RFK Jr. is someone who won nearly $290 million for a Roundup cancer victim in 2018. Who built his career proving in court what glyphosate does to human bodies. Then he took a cabinet seat, backed the executive order that shielded Bayer, and told his followers that “unfortunately, our agricultural system depends heavily on these chemicals.”
That isn’t constraint. That is capitulation, dressed up in the language of pragmatism to make cowardice sound like wisdom.
There was a moment when he could have resigned in public protest, used his name and documented expertise to blow this open before the court ruled. He chose the title. He chose the access. He chose himself.
The people who trusted him paid for that choice today, in verdicts, in bodies, in cancer diagnoses that will never be traced back to a bottle with no warning on the label.
Courage in this moment would have looked like one person with power saying no, loudly, at personal cost. What we got was a 7-2 ruling and a press release.
The courtroom was one avenue. It’s narrowed.
The leaders who should have stood here didn’t. The ones with the credentials, the platforms, the access, the names large enough to have made this fight visible at the scale it deserved, they calculated their risk and chose their careers. That is the record.
Remember it.
But here is what I want you to understand about this moment: Bayer’s stock rose 17% this morning before trading had to be halted. Not because they proved Roundup is safe. Not because the science changed.
