The far-right faction of the Supreme Court, which unfortunately for us is the majority of the justices, call themselves “originalists.” This concept is based on “a theory of interpreting legal texts holding that a text in law, especially the U.S. Constitution, should be interpreted as it was understood at the time of its adoption.” Of course this is the purest form of self-justifying bullshit, and utterly contrary to their actual performance.
Their latest and worst decision to date, Trump vs United States, has created powers for the Office of President that do not exist in the Constitution and also grant themselves non-existent powers on top of that. They have essentially appointed themselves as arbiter of the Executive Branch, corrupting the Constitutional structure of checks and balances among the three co-equal branches of government.
That this smacks of rampant corruption is obvious. But it is more than that. Each justice that signed on to the Roberts opinion, and Roberts himself, violated their oath off office taken when they were sworn in to their lifetime positions. Justices take a combined Judicial and Constitutional Oath:
“I, _________, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as _________ under the Constitution and laws of the United States; and that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”
By altering the very foundation of our Constitution in favor of a convicted criminal, racist and rapist, the majority of the Court has abrogated their oath.
If ever there was a domestic enemy of the Constitution it was Donald Trump, his backers and his enablers. The stated and published intent of this group is the destruction of the United States government and its constitutional structure.
Not only has the court now granted extraordinary powers to the Executive, they have destroyed the probabilities of prosecuting Trump before the election for his very real and very obvious crimes. This should make these justices parties to those crimes by the fact of obstructing the process of judgement against Trump. They are aiding and abetting his criminal and treasonous acts.
The Office of President was never intended to be that of a monarch or dictator. The first precedent for this fact was set by George Washington when he declined those powers, not once but twice.
Donald Trump tried to destroy that precedent on January 6th, 2021. We can never forget or forgive that. Nor should we ever forget or forgive those who aided, planned, facilitated and then denied that it ever occurred. That group of unforgivables now includes the far-right Supreme Court majority.
